Terms of Sale
These Terms and Conditions establish a legally binding agreement between the client ('you') and 'DYNAMIX DIGITAL PTY LTD' trading as 'House of Diamonds' (ABN 54 661 859 141) ('House of Diamonds') and pertain to the ordering, purchase, fulfillment, and delivery of goods ('Goods') from www.houseofdiamonds.com.au
By placing an order for Goods from House of Diamonds, you acknowledge and agree to these Terms and Conditions.
Kindly review the following Terms and Conditions thoroughly before proceeding with your order.
SECTION 1: Legal Rights
Your acquisition of Goods is accompanied by guarantees as per the Australian Consumer Law. Under these laws, all products must meet acceptable quality standards, be reasonably fit for their intended purpose, and align with the relevant description. In the event of a major failure with our goods or services, you have the right to a replacement, refund, and compensation for any reasonably foreseeable loss or damage resulting from our product or service. If the goods do not meet acceptable quality standards but the issue does not constitute a major failure, you are entitled to have the goods repaired or replaced.
SECTION 2: Prices and Taxes
Prices for Goods are showcased on our websites.
House of Diamonds retains the right to alter the prices of Goods at any time without prior notice to you.
All prices of Goods are quoted in your local currency (or USD). Local taxes and duties may apply to your order.
SECTION 3: Orders
3.1 Placing an Order
Once you are prepared to make a purchase by adding items to your Cart, proceed to Checkout and finalize your order.
You recognize and accept that:
An Order submitted by you is considered an offer to purchase the Goods at the displayed price at the time of submitting your Order. House of Diamonds may accept or reject your offer at its absolute discretion;
Carefully review your Order, as it may not be cancellable once accepted by House of Diamonds;
Your order, upon acceptance by House of Diamonds, establishes a separate and binding agreement between you and House of Diamonds regarding the supply of the Goods, in accordance with these Terms and Conditions and Terms of Sale;
All the information you provide is complete, true, and accurate.
3.2 Offer and Acceptance of an Order
Upon submitting an Order, you will receive an automatic email acknowledging receipt of your Order. Please note that this acknowledgment does not imply acceptance of your Order, even if payment has been made. Your Order constitutes an offer to purchase the Goods at the price specified in the Order.
All Orders are subject to our acceptance. We are not obligated to accept your Order and may, at our discretion, decline it. However, by completing the check-out process, you commit to paying for the Goods if your Order is accepted by us.
Client orders are officially accepted by House of Diamonds upon processing and approval at our headquarters.
Our acceptance forms a binding agreement between you and House of Diamonds for the supply of the Goods, in accordance with these Terms and Conditions.
In certain circumstances, House of Diamonds may cancel your Order after Payment as outlined in these Terms and Conditions. Such circumstances include, but are not limited to the following:
- Product out of stock or discontinued
- Incorrect price or product description (as per Section 2 "Prices and Taxes")
- Website or technical error causing a price change during the checkout process
- Suspected fraud in accordance with Section 3.3 of these Terms and Conditions.
- In such cases, House of Diamonds will promptly contact you with available options.
- If House of Diamonds cancels your Order after payment processing, a refund will be issued.
- House of Diamonds reserves the right to rectify any errors and apologizes for any inconvenience caused.
3.3 Payment of an Order
Orders are accepted via credit cards (please refer to us for a list of accepted credit cards) and House of Diamonds Gift Card.
House of Diamonds may decline to accept payment for various reasons, including, but not limited to:
- Mismatch between the name on the credit card/account and the Order, or suspicion regarding the Order and Payment;
- Detection of possible irregularities by our fraud detection systems;
- Declined payment or suspicion of a breach by your financial institution;
- Expired credit card.
- In such cases, House of Diamonds may refuse to accept your Order or put it on hold, requesting additional information (such as proof of identity documents).
- If no response is received or proof of identity is not accepted due to suspected fraud, House of Diamonds reserves the right to cancel your Order.
3.4 Cancellation of Orders
House of Diamonds retains the right to cancel, at any time before delivery and for any reason, an Order that was previously accepted. Reasons for cancellation may include those listed in Clauses 3.2 or 3.3, or reasons such as:
- Goods subject to an error on the Website (technical errors, description, price, or image errors) not discovered prior to Order acceptance;
- Inability of House of Diamonds' suppliers to provide Goods promised earlier;
- Unforeseen events beyond House of Diamonds' control (e.g., storm, fire, flood, earthquake, terrorism, power failure, computer system failure) preventing timely supply of Goods;
You may request Order cancellation only:
- If House of Diamonds has breached a material term of this Agreement;
- Before acceptance by House of Diamonds;
- In the event of Order cancellation, where Payment has been processed, House of Diamonds will refund any payment made for that Order.
- House of Diamonds is not liable for any loss, damage, cost, or expense resulting directly or indirectly from Order cancellation.
SECTION 4: Availability and Delivery of Goods
4.1 Availability
The majority of House of Diamonds' items are made to order, with jewelry taking approximately six to eight weeks (subject to change during peak periods) depending on the item. While House of Diamonds endeavors to deliver goods promptly, delays can occur. Availability of stock items and delivery times for any products cannot be guaranteed at all times.
For the most accurate information and timing on a piece of jewelry, please contact us directly.
You acknowledge and agree that:
- Delivery times may vary for different products;
- Any delivery times provided are approximate, and further delays may occur;
- Delays may happen during busy seasons.
- House of Diamonds will not be liable for any loss, damage, cost, or expense resulting directly or indirectly from delayed delivery of the Goods or delayed availability of Goods for in-person pickup.
4.2 Delivery
The risk and title of the Goods pass to you on the date and time of delivery to the address specified in your Order. Please note that this excludes requiring a signature on delivery from you.
After dispatching your Goods, House of Diamonds will email you a confirmation of dispatch with a tracking number for location tracking.
You may be required to sign for proof of delivery upon receipt. If you are unavailable, your parcel may be taken to your nearest Post Office, Depot, or Other Postal Hub for collection.
If your parcel is returned due to an incorrect address provided by you, or if you are unavailable or fail to collect your package within a reasonable timeframe, we will attempt re-delivery at a later date, potentially incurring a reasonable fee. We will contact you for approval before proceeding.
4.3 Pick up of Goods in store
You may opt to conveniently pick up your Goods at the House of Diamonds showroom. This option can be selected during the checkout process on the House of Diamonds website, and there is no charge for this service.
You acknowledge and agree that:
- Only the person who placed the order may pick up the Goods in-store, unless otherwise agreed between you and House of Diamonds. House of Diamonds may request photo identification upon pickup to verify your identity. If requested, you must allow House of Diamonds to take a copy of the provided identification for fraud prevention purposes. The copy of identification will not be used for any other purpose.
- You may pick up the Goods once the Order has been accepted by us and a notification has been sent to you indicating that the Goods are ready for collection.
- House of Diamonds reserves the right to refuse the collection of Goods if you fail to meet the requirements outlined above.
SECTION 5: Refunds of your Money
If House of Diamonds is obligated to refund your payment according to these Terms and Conditions, you acknowledge and agree that:
- House of Diamonds will strive to process your refund within 2 business days during business hours, unless otherwise specified;
- The refund may be processed in part payments of $1000 AUD in accordance with merchant bank processes;
- The actual time it takes for you to receive your refund depends on how quickly your financial institution processes the refund.
SECTION 6: Overdue Payment
If the client has not responded to our final payment request within 28 days of completion, House of Diamonds reserves the right to sell or repurpose the item as payment for the product or service provided. This will only be done as a last resort, with every effort made to allow the client to make payment and collect the item before taking such action.
SECTION 7: Uncollected Goods
Clients with goods not collected within 28 days of the completion notice will receive a final notification to collect their goods. If no response is received after 90 days, House of Diamonds reserves the right to dispose of the goods.
SECTION 8: Return of Goods
Check your Goods upon delivery to ensure they have not been damaged in transit. If any damage is noticed, contact House of Diamonds immediately.
For issues with received Goods, refer to our Returns Policy, which is an integral part of these Terms and Conditions.
To return goods, follow these instructions:
- Contact us first to inform us of your intention;
- Securely wrap the jewelry in its original packing or a protective shipping container with bubble wrap or a padded envelope;
- Include a note with your contact details and reason for return;
- Postage and insurance are your responsibility and at your expense. For your protection, ship your item insured, with a tracking number and proof of delivery, such as a signature by us on receipt;

House of Diamonds will contact you upon receiving your return.
By returning your package, you acknowledge that House of Diamonds is not responsible for items lost or damaged during shipping.
SECTION 9: Privacy
House of Diamonds' policy on the collection, use, and disclosure of clients' personal information is outlined in its Privacy Policy, which is an integral part of these Terms and Conditions.
SECTION 10: General
Your use of this website is governed by the Terms and Conditions.
House of Diamonds reserves the right to amend these Terms and Conditions at any time, without notice to you. Any amendment takes effect from the time it appears on the Website.
These Terms and Conditions are governed by the law of New South Wales, Australia.
